Position Summary:

The Litigation Counsel is responsible for assisting the NAM Legal Center in litigating on behalf of the NAMs 13,000+ members on a broad range of issues and in advocating to policy makers on policies and legislation to ensure a level playing field for NAM members in the courts. The NAMs litigation program consists of direct legal challenges to federal regulations and other government actions, interventions in support of the government to defend sensible regulatory reforms and other pro-manufacturing actions, and the filing of amicus curiae briefs to bring the voice of manufacturers to the courts on precedent-setting issues.

In a typical year, the NAM files around 60 briefs through our amicus program and party litigation matters (where NAM is the plaintiff or intervenor). The legal issues and topics on which we engage are as broad and diverse as the members we represent, ranging from labor and employment, energy and the environment, product liability, class actions, immigration, tax, trade, intellectual property, manufacturers free speech rights, False Claims Act, international issues, jurisdiction, administrative procedure, antitrust, arbitration, discovery, communications, insurance, and securities regulation. As a litigation generalist covering these topics and more, the Litigation Counsel is expected to dive into new subject matters with gusto and become conversant on the legal issues involved.

This dynamic position will report to the NAMs Deputy General Counsel, who in turn reports to the NAMs Chief Legal Officer. The Litigation Counsel will work very closely with the Deputy General Counsel to identify, vet, manage, and resolve the cases under his or her responsibility. Through this process, the Litigation Counsel regularly engages with in-house counsel from the NAMs member companies, outside law firms and allied groups. The Litigation Counsel also serves a critical in-house function to the NAMs large policy team, providing legal analysis of emerging issues and reviewing and providing legal arguments for comment letters, testimony and other advocacy.

The Litigation Counsel is also responsible for communicating with members through a weekly newsletter that contains updates on the NAMs litigation and important legal and regulatory developments.

The Litigation Counsel additionally helps support the NAMs Legal Policy agenda, working to influence policies and legislation that ensure a level playing field for NAM members in court and fair liability standardsrelevant issues include Third Party Litigation Funding, amendments to the Federal Rules of Evidence or Federal Rules of Civil Procedure, the False Claims Act, and more.

Day to Day Responsibilities :

  • Responsible for helping to develop party litigation and amicus briefs in which NAM participates on legislative, regulatory, tort liability and other matters in support of manufacturers.
  • Engages outside counsel, helps develop the legal strategy and arguments, and reviews and edits briefs drafted by outside counsel.
  • Identifies litigation opportunities to strategically advance the interests of manufacturers and the manufacturing economy.
  • Helps to build and manage relationships with allied groups, including building and managing litigation and advocacy coalitions.
  • Coordinates and collaborates with the NAMs Policy and Government Relations Department to ensure consistency with NAM policy positions.
  • Analyzes proposed policy & legislation to determine possible effect on the interests of NAM member companies and becomes conversant on the subject matter.
  • Proactively engages with NAM member companies on litigation and legal policy issues and responds to member companies' requests, questions and concerns in a timely, accurate and professional manner.
  • Publicizes and explains legal case or legislative developments to NAM members, staff, and other key stakeholders through our weekly legal newsletter and with ad hoc calls and meetings as appropriate.
  • Helps to build and manage legal programming to support and educate the NAMs members.

Requirements:

  • J.D. from an accredited law school and membership in a state bar.
  • Three to five years' litigation and/or policy experience in a law firm, a federal regulatory agency, trade association, or major company is strongly preferred.
  • Experience with public policy issues and handling litigation initiatives with governmental bodies strongly preferred.
  • Excellent analytical, organizational and writing skills are essential.
  • Experience in any of the following legal fields is preferred but not required
  • Energy & Environmental law
  • Strong project management and organizational skills.
  • Strong interpersonal skills.
  • Attention to detail and high degree of accuracy.
  • Computer proficiency with Windows, Microsoft Office Suite (Word, Excel and Power Point), and the Internet.
  • Strong team player.
  • Ability to work effectively in a fast-paced, quality and goal-driven work environment.

Salary Range:

$155,000 $169,000 annually. This salary range represents a good faith estimate of the lowest to the highest salary for this position. The final salary offered will be based on qualifications and experience.
